h2>1. Agreement

These Terms of Service (“Terms”) govern purchases from The Pine Straw Store LLC (“we,” “us,” “our”). By placing an order you agree to these Terms. We may revise these Terms at any time; the version in effect when you place an order governs that order.

2. Orders, pricing, and pre-orders

Prices, product availability, and shipping arrangements may change at any time. Pre-orders are charged at the time of purchase and ship in the window stated on the product page or on the ship-out date selected at checkout. Pre-orders may be canceled for a full refund at any time before shipment.

3. Coverage estimates

Our pine straw is compressed for shipping to keep delivery costs down. Square-footage figures describe straw spread on the ground in a decorative fashion at an approximately 2-inch depth — they are not the dimensions of the box or pallet, and coverage cannot be calculated from package volume. Coverage figures are good-faith estimates, not guarantees; actual results depend on how deeply the straw is spread.

4. Our guarantee

Standard box and pallet orders are covered by our 60-day, 100% money-back guarantee as described in our Refund Policy, which is incorporated into these Terms. If anything in these Terms conflicts with that guarantee for a covered order, the guarantee controls.

5. Delivery

Orders containing multiple products may arrive as split shipments at no additional charge. Please note visible damage with the delivery driver where possible; this assists our claims with the carrier but does not affect your guarantee coverage. Shipments returned to us because an incorrect delivery address was provided will be held at our facility, and reshipping may require an additional shipping payment.

6. Safety

Dry pine straw is a flammable plant material. Keep it away from open flames, grills, fire pits, heaters, and any other source of heat or sparks.

7. Wholesale truckloads

Wholesale truckload shipments are made nationwide except to states that prohibit importation of volume loads without a phytosanitary certificate. Truckload deliveries include a Bill of Lading (“BOL”) presented by the driver, and the buyer must inspect the product at the time of delivery. Once the BOL is signed, the delivery is accepted and all truckload sales are final.

8. International orders

International pine needle shipments are sold EXW (Augusta, GA), CIF (port of destination), or FAS (Port of Savannah) as defined by INCOTERMS® 2020. The buyer is solely responsible for due diligence, all import and export documentation, and all duties, taxes, port handling, and customs charges; no refund is available if a customs authority restricts importation. No offer to sell or agreement arises until a commercial invoice is signed by buyer and seller, and a price list does not constitute an offer. Claims for shortages or other errors must be made in writing within 15 days of receipt of shipment; failure to give such notice constitutes unqualified acceptance and a waiver of such claims. All international sales are final once the product leaves our facility. Products are subject to the export-control laws of the United States, and the buyer agrees not to divert or resell goods contrary to those laws. Delay in delivery of any shipment does not relieve the buyer of its obligation to accept remaining deliveries.

“Pine Straw Store” and associated names, logos, and marks are trademarks of The Pine Straw Store LLC and may not be used without our prior written permission.

10. Disclaimer of warranties

EXCEPT FOR THE EXPRESS GUARANTEE DESCRIBED IN SECTION 4, THE PRODUCTS AND SERVICES OF THE PINE STRAW STORE LLC ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY, ACCURACY, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING, OR USAGE OF TRADE.
