THE PINE STRAW STORE LLC is able to provide tracking, time in transit, and information related to the shipment of packages via E-mail. The information gained from us is to be used by you solely in connection with packages shipped by THE PINE STRAW STORE LLC and for no other purpose. If we make an error with your order, we will fix the order immediately at no charge to you. If you made an error with your order, unfortunately we can not issue a return or refund because we are unable to recover our cost on items. All of our estimated figures are in an uncompressed form that is equivalent to the pine straw being placed on the ground in a decorative fashion, not as if it were a solid block. There are no guarantees by us that your calculations will match our calculation. If the product is damaged at the time of arrival to its ordered destination, please note this with the delivery person. THE PINE STRAW STORE LLC can not put in a claim for damage that has not been noted with the delivery person at the time of arrival. Everything is checked for it's condition prior to shipping, so a refund for damage can only be claimed if it is noted at the time of arrival. If you are sent a damaged or defective product, we will issue a new product after the old product is returned to us. Once the Straw has been removed from the box or pallet at its ordered destination, a refund will not be given in any form. You may receive more than one shipment when you place an order with multiple products. You will not incur additional shipping charges for the split shipment. Any items sent back to us because the wrong shipping address was provided will be held at our facility until buyer pays for shipping again. If THE PINE STRAW STORE LLC decides that a refund is due for any reason, the refund shall be the total amount paid minus freight. If the customer is due a refund, the refund will be credited in the same manner that was used to make the purchase. This must be done within 10 working days of your purchase. We do not cover the cost of return shipping. By placing an order with THE PINE STRAW STORE LLC, you agree to waive venue and jurisdiction to Richmond County, Georgia for any possible liability regarding our products or the ordering of our products. THE PINE STRAW STORE® may revise and update these terms and conditions at anytime. THE PINE STRAW STORE LLC may also establish or change, at any time, general practices and limits concerning products provided through THE PINE STRAW STORE LLC at its sole discretion. Prices and shipping cost are subject to change at any time. You can not take the cubic feet of our boxes and figure out the square feet of ground that the straw will cover to an exact. The reason for this is that pine straw is very bulky, so we compress our straw in boxes to keep the shipping cost down. The square footage has been calculated with the straw placed on the ground in a decorative fashion and not with the dimensions of the box. Under no circumstances shall THE PINE STRAW STORE LLC be liable for any special, incidental or consequential damages, including, but not limited to, damages arising from delayed delivery, failure to attempt delivery, or the unavailability or refusal of a person to accept delivery of the shipment. If you order the the wrong type pine straw, you do not qualify for a refund. We will work with you on this issue but no shipping charges will be refunded and you will be fully responsible for all additional shipping cost. Freight on all pallet orders is NON-REFUNDABLE. If, for any reason, you decide that you do not want the "pallet order" after it has left our facility, you must return ship the "pallet order" to us in the same manner and condition that it was shipped to you. The pallet of pine straw shall be dropped at the foot of the driveway by the freight company. The Pine Straw Store LLC is not responsible for return freight charges. If the "Pallet Order" is returned to The Pine Straw Store L.L.C., the "pallet order" must be in the exact condition (not opened) as when it left our facility before a refund may be issued. All returns must have a Return Authorization Number (RAN). You must call The Pine Straw Store LLC to obtain a RAN number. All sales are final 10 days after the date of delivery. The Pine Straw Store LLC shall not be liable, whether jointly, severally or individually, in excess of the amount paid to the The Pine Straw Store LLC for the products purchased under these Terms and Conditions. The buyer of any and all products agrees to defend, indemnify and hold harmless The Pine Straw Store LLC and its staff for any claims which may arise from use of our products. The Pine Straw Store LLC will not be liable for any property damage, personal injury, loss of use, interruption of business, loss of profits, or other consequential, indirect, incidental, punitive or special damages.The delivery of products, at the request of the buyer, shall be acceptance and waiver by buyer of any and all claims against The Pine Straw Store LLC. Transactions between buyer and The Pine Straw Store LLC shall be governed by and construed in accordance with the laws of State of Georgia, USA, without regard to the laws regarding conflicts of law. Any litigation regarding this agreement or any transaction between buyer and The Pine Straw Store LLC or any action at law or in equity arising out of or relating to these agreement or transaction shall be filed in Richmond County, Georgia and the customer hereby agrees, consents and submits to the jurisdiction of such courts for the purpose of litigating any such action. All objections to such jurisdiction and venue are hereby waived. Avoid placing or storing pine straw near heat sources or areas where sparks may ignite the pine straw. Pinestraw may be inflammable. Disclaimer: The products and/or services provided by The Pine Straw Store, L.L.C. are provided “AS IS,” WITHOUT WARRANTY OF ANY KIND TO THE CUSTOMER OR ANY THIRD PARTY, INCLUDING, BUT NOT LIMITED TO, ANY AND ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF: (1) MERCHANTABILITY; (2) FITNESS FOR PARTICULAR PURPOSE; 3) EFFORT TO ACHIEVE PURPOSE; (4) QUALITY; (5) ACCURACY; (6) NON-INFRINGEMENT; (7) TITLE; (8) MARKETABILITY; (9) PROFITABILITY; (10) SUITABILITY; AND/OR (11) ANY TYPE ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING, OR USAGE OF TRADE. THE CUSTOMER AGREES THAT ANY EFFORTS BY THE PINE STRAW STORE, L.L.C. TO MODIFY ITS GOODS OR SERVICES SHALL NOT BE DEEMED A WAIVER OF THESE LIMITATIONS, AND THAT ANY THE PINE STRAW STORE, L.L.C. WARRANTIES, IF ANY, SHALL NOT BE DEEMED TO HAVE FAILED OF THEIR ESSENTIAL PURPOSE. THE CUSTOMER FURTHER AGREES THE PINE STRAW STORE, L.L.C. SHALL NOT BE LIABLE TO THE CUSTOMER OR ANY THIRD PARTY FOR ANY LOSS OF PROFITS, LOSS OF USE, INTERRUPTION OF BUSINESS, OR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHETHER UNDER THIS AGREEMENT OR OTHERWISE, EVEN IF THE PINE STRAW STORE, L.L.C. WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR WAS GROSSLY NEGLIGENT. Some jurisdictions do not permit the exclusion or limitation of liability for consequential or incidental damages, and, as such, some portion of the above limitation may not apply to the customer. In such jurisdictions, The Pine Straw Store, L.L.C.’s liability is limited to the greatest extent permitted by law.

International Pine Needle Shipments are sold (EXW) EX WORKS AUGUSTA, GA 30906, CIF (Port of Destination), and FAS (Port of Savannah) as defined by INCOTERMS 2000 which is set by the International Chamber of Commerce. The "buyer" is fully responsible for conducting their "Due Diligence" , THE PINE STRAW STORE LLC ( the "Seller") will not be held responsible for any paper work required by any importing Country or State. All import and or export documentation is the responsibility of the "buyer" and under no circumstances shall THE PINE STRAW STORE LLC be liable for any special, incidental or consequential damages. No "offer to sell" or "agreement" will arise until the commercial invoice is signed by the buyer and the seller. If a "Price List" is sent to the "Buyer", this in no way constitutes a sales agreement. All sales are final on shipements once the product leaves our facility. International shipments come with a Commercial Invoice that state the value of the goods ordered and labelled "Pine Needles". "Buyer" needs to ensure products ordered can pass customs at port of import, no refunds can be issued by The Pine Straw Store LLC should your customs department restrict importation. "Buyer" is responsible for adhering to the customs regulations in your own Country / State and paying any fees / duties / taxes / port handling fees / customs charges that may be required. PRICES: Unless otherwise specified in writing by "Seller", all prices are exclusive of taxes, customs, duties, transportation and insurance, and any and all current or future tax or governmental charge. All Products by "Seller" are subject to the export control laws of the USA, and Buyer agrees not to divert or resell the Goods contrary to such laws. If any license or consent of any government or other authority is required for the acquisition, carriage or use of product by Buyer, Buyer will obtain at its expense and provide evidence to Seller on request. Delay in delivery of any shipment shall not relieve "buyer" of its obligations to accept remaining deliveries. Claims for shortages or other errors must be made in writing to The Pine Straw Store LLC within fifteen (15) days after receipt of shipment, and failure to give such notice shall constitute unqualified acceptance and a waiver of all such claims by the "Buyer".

Wholesale Truckload shipments are made nationwide except for those States that prohibit the importation of volume loads without a phytosanitary certificate from the USDA. All "Wholesale Truckload" shipments will come with a Bill Of Lading (BOL) and the driver will present this at the time of delivery. The "Buyer" is to inspect the product at the time of delivery. Once the Bill Of Lading is signed, the "Buyer" has fully accepted the delivery and at that point, ALL SALES ARE FINAL. THE PINE STRAW STORE LLC ( the "Seller") will not be held responsible for the product in any manner.
